An Orange County Superior Court judge approved a $125 million settlement on Monday, October 19, 2026, resolving the civil case over the May chemical emergency at the GKN Aerospace facility in Garden Grove. The approval clears the way for a claims program that could reach tens of thousands of residents.
What Happened in Garden Grove
The emergency began on May 21, when a chemical storage tank at the plant overheated. Fire officials warned that the tank could explode or release a toxic chemical.
More than 50,000 people in Garden Grove, Stanton, and nearby communities evacuated over Memorial Day weekend. Many were out of their homes for several days.
Officials said a crack in the damaged tank eventually relieved the pressure, which removed the risk of an explosion. Crews then worked to neutralize and remove the chemical.
What the Settlement Includes
The agreement was reached between the Orange County District Attorney’s Office and GKN Aerospace Transparency Systems, Inc., and GKN Aerospace, Inc.
Claims Program of Up to $100 Million
Residents and businesses affected by the evacuation may be able to seek reimbursement for hotel stays, meals, transportation, lost wages, and loss of use. GKN has said it would open the program within days of court approval.
$15 Million in Civil Penalties
The District Attorney’s Office will receive $15 million in penalties under state law. The funds are earmarked for consumer protection enforcement.
More Than $8.4 Million for Emergency Response
Agencies that responded to the emergency will be reimbursed $8,471,385.50. That includes the county, local fire and city departments, and state and federal environmental agencies.
Seven Years of Independent Monitoring
GKN agreed to seven years of oversight, including an independent expert who will check that the plant follows applicable laws and regulations. The company will pay $1.4 million for that monitoring.
What to Do Now If You Evacuated
Start by gathering your records. Hotel receipts, meal and gas receipts, rideshare charges, and pay stubs showing missed work can all support a claim.
Details on how to apply are posted on GKN’s Garden Grove community updates page, which the District Attorney’s Office points residents to.
If you believe you were exposed to the chemical or developed symptoms, see a doctor and keep the paperwork. A medical record created soon after an incident can carry real weight later.
Why a Claims Program May Not Tell the Whole Story
A claims program is built around defined expenses. It may not address every kind of harm, such as ongoing health problems or larger financial losses.
Separate civil class action lawsuits over the incident have also been reported as pending, according to company disclosures. Before you sign anything, it helps to understand what rights you may be giving up.
California generally gives people two years to file a personal injury lawsuit, so waiting too long can limit your options.
