A Kern County jury has ruled in favor of the family of Demi Dominguez, a 23-year-old Bakersfield mother who died in April 2019 along with her newborn son, Malakhi. On October 21, 2026, jurors found former OB-GYN Arthur Park negligent and a substantial factor in both deaths. Local outlets report the award at roughly $9.25 million to $9.5 million.
The verdict comes seven years after the loss. Maternal health advocates across the Central Valley followed the case closely.
What Happened to Demi Dominguez
Demi was nearly eight months pregnant when she went to Mercy Southwest Hospital with high blood pressure and swelling. She stayed about 13 hours and was discharged. Three days later, she suffered a fatal seizure at home.
Her family argued that she showed warning signs of severe preeclampsia and should have remained hospitalized. Their medical expert testified that five of her blood pressure readings reached the severe range. The expert said she should have received IV magnesium.
Park represented himself at trial. He testified that Demi had preeclampsia, but not its severe form. He also questioned some of the readings, suggesting stress or a faulty cuff could have affected them.
The family’s attorney pointed to nursing records. Those records showed staff had discussed Demi’s blood pressure and lab results with Park.
Kern County Jury Finds Former OB-GYN Negligent But Family Will Not Receive the Full Award
The jury’s number is not what the family will collect. The case was filed while California’s older cap on medical malpractice damages was still in effect. Under that limit, the family can recover only $250,000.
Collecting even that may be difficult. Park has said he cannot pay. Another physician named in the lawsuit, Dr. Hans Yu, settled with the family before trial for an undisclosed amount.
Park has since surrendered his medical license.
What This Case Means for California Families
Cases like this show how much the details of a medical malpractice claim matter. When a claim was filed, who is named as a defendant, and how damages are limited can all change what a family actually receives. Cases filed more recently may fall under updated damages limits, which is one more reason timing matters.
Medical malpractice and wrongful death claims also follow strict filing deadlines. Waiting too long can end a case before it starts.
If you suspect a medical provider’s negligence contributed to a loved one’s injury or death, early legal guidance helps. An attorney can gather medical records, consult qualified experts, and explain what recovery may realistically look like.
